1. Call meeting to order: roll call, determination of a quorum.
Janie Greenspun-Gale, President of the Board, called the meeting to order at 6:00 P.M.

2. Welcome members of the Public: James Jackson (Legislative Counsel for the board) arrived at the board office in Las Vegas while the meeting was in progress. The following were present in Reno:

3. Approval of minutes of October 7, 2000 meeting
Motion: Frank Shallenberger motioned to approve minutes
Second: Dr. Royal
Action: Passed Unanimously

4. Applicants

A. Advanced Practitioners of Homeopathy
Discussion: Frank Shallenberger spoke regarding the testing material; it was his impression that the applicants were to be tested on the material they are studying and trained in; and there was no pre-study seminars for them to attend prior to the testing. Dr Royal recommended to review the protocol and testing and would formulate a way to design a test that would be considered fair. Mary Marsh Linde, representing the Nevada Homeopathic and Integrative Medical Association (NHIMA) and Mr Donaldson and Mr. Field, referred to her November 15, 2000, letter to the board. She stated that neither the association nor the two applicants had received a statement from the board setting forth the scope of the examination to be administered to an applicant for certification examination of an Advanced Practitioner of Homeopathy (APH). Deputy Attorney General legal adviser to the board, Bob Bryant, stated the board needs to clearly define the material from which an applicant is to tested prior to the examination. Kelly Turner stated the law requires that each applicant for HMD and APH must be examined for a general knowledge of homeopathy as defined in NRS 630A.040. Dr. Minton offered to review all questions selected for use in the examinations to assist the NHIMA in establishing a course for preparing applicants for taking the examination. Discussion followed as to action that the board could take in regards to the two applicants that failed the examination administered in October, 2000. Dr. Royal informed the board that the regulation for administering the previous examination was not officially in place until approved by the Legislative Commission on December 12, 2000. Therefore, the board could nullify the results of the previous examinations of the two applicants in question, and could administer another exam to them during its next meeting.
Motion: Dr Minton motioned to allow Mr. Donaldson and Mr. Field to retake the exam on March 31, 2001, during the next Board meeting, without cost to the applicants

B. Applicants to be "Grandfathered in" as Homeopathic Assistants (HA):
Discussion: The following applicants have had their applications reviewed and are qualified: Patricia Ann Pia, Theresa Turner, Connie Peterson, Melissa Kock, Kenneth McAdams, Larene Rammell, Kathleen Stuart, Sandra Sharp, Sammy Valera, Gerardo Castiollo, Dolora Cantin, Roasa Quintana. Ino Quintana, Filipina Yap, Algelica Alix, Teresita Alix.
Motion: Dr. Shallenberger motioned to approve all of the applicants
Second: Kelly Turner
Action: Passed Unanimously

5. General Discussion

A. Status of Adopted Regulations, LCB File No. R 058-00
Discussion: Dr. Royal informed the board that the regulation for administering the previous examination was not officially in place until approved by the Legislative Commission on December 12, 2000. The regulation was reviewed by the board.
Action: President Gale appointed Dr. Minton, Kelly Turner, and Dr. Royal to serve as members of the Educational Review Committee
Motion: Dr Royal motioned that the current list of "Approved Courses" continue to be approved by the board until the committee has time to investigate and report to the board courses to be approved for potential applicants during a future board meeting.
Seconded: Kelly Turner
Action: Motion Passed

B. Review of Proposed Bill Drafts for 2001 Legislature
Mr. Jackson stated that nothing has changed on these and would refer to them later. The bills (BDR # 54-578 and BDR # 619) are ready to go and should be on LCB website. Janie asked if there was any opposition. Mr. Jackson believes these bills should be "tabled" for this legislative session in view of the legislators' attention being directed to other matters. Dave Edwards reported that the Office of the Governor is backing both bills, but recommended the board adhere to the counsel and advice of its legislative counsel at this time. Dr Royal recommended that the board continue to support both bills if they go forward, based upon Mr. Jackson's advice.

C. Request for Information as to whether or not an Advanced Practitioner of Homeopathy can be a physician of veterinary medicine
Discussion: Not within the purview of the board. This is a matter for the Nevada State Board of Veterinary Medicine to decide.
Action: No Action

D. Approval of Available Courses for Applicants (see 5A)

E. Approval of Licensees as Supervisor
Discussion: Applications for approval submitted by: Drs. Royal, Edwards and Ibarra.
It was noted that Dr. Ibarra submitted a letter, but will need to fill out an application and have it notarized. Dr. Edwards suggested that forms be mailed again to all HMDs, giving licensees until the next board meeting to submit their applications.
Motion: Dr. Edwards made a motion that we use the same supervisor request form for HMD and APH trainees; effective as long as the doctor is in good standing.
Second: Frank Shallenberger
Action: Motion Passed

F. Committee to Investigate Complaints
Action: Janie Gale appointed Dr Minton, Dr. Shallenberger and Diane Kennedy to the complaint committee.

G - No discussion -

H. Use of Murphy's Homeopathic Medical Repertory as Reference for Future Exams
Motion: Dr Minton made a motion to refer this to the committee
Second: Dr. Royal
Action: Passed unanimously

I. Report of Secretary Treasure: The board was informed as to the balance of funds.
J. Office of Executive Director
Terri Stucky reported that all members, except Dr. Daniel P. George, had paid renewal fees. Signed Certificates and ID cards will be mailed to the new HA's.

K. Deputy Attorney General Report (None)

L. Scheduling of Board meeting dates and locations

Next Board meeting will be Saturday, March 31st, in Reno.

M. Public Comment & Discussion (None)
