Minutes

1. The President and Vice President were not in attendance to begin the meeting. Board Secretary-Treasurer, Fuller Royal, called the meeting to order at 5:40 p.m.,
visitors were welcomed, asked to identify themselves, and sign in.

2. Board Members and Staff Present: Fuller Royal, Phillip Minton, Daniel Royal, Wendy Gallerani (Executive Director), Linda Read, David Edwards, Ned Reed (Deputy Attorney General), Janie Greenspun-Gale (arrived late).

Board Member Absent: Diane Kennedy

Visitors Present: James Forsythe

3. Motion: David Edwards moved that the minutes of March 22, 2003 Board
meeting be approved.
Second: Linda Read
Action: Passed unanimously

4. Fuller Royal stated that the Executive Director, Wendy Gallerani, advised Dr. Carol Barlow in writing that she had lapsed beyond the 60 day limit granted for renewal of licensing, and that her Homeopathic License has been suspended. Dr. Barlow has written a letter to the board asking for reinstatement. She has paid the fee required for reinstatement, which is twice the amount of the renewal fee, and the board has received one letter recommending her reinstatement.

A discussion ensued as to whether or not any letters of recommendation were needed. Legal counsel stated that the board could reinstate Dr. Barlow without any letters of recommendation. Dr. Barlow has met all necessary requirements.

Motion: Phillip Minton moved to reinstate Carol Barlow's license immediately.

Action: Passed unanimously

5. Discussion of the proposed regulations of the Nevada Board of Medical Examiners. Fuller Royal stated that, if enacted, the regulations would affect all dually licensed physicians. No Action Taken

6. Discussion of establishing a committee to review NRS 630A to make recommendations to the board for additions/deletions to Chapter 630A of NRS during the 2005 Legislative Session. No Action Taken

7. Discussion of establishing a committee to review NAC 630A to make recommendations to the board for additions/deletions to Chapter 630A of NAC.
No Action Taken

8. The board received a letter from David Edwards requesting a declaratory order and advisory opinion as to whether External Counter Pulsation Therapy and Insulin Potentiation Therapy qualify as "Homeopathic Practice" as defined by NRS 630A.040. David Edwards withdrew his request in regards to External Counter Pulsation Therapy. He stated that some licensees are using Insulin Potentiation Therapy (IPT) in their practices. Licensees need to know whether the homeopathic or allopathic board will be regulating such therapy, since small doses of a pharmaceutical agent are being used.

Dr. James Forsythe stated that the Homeopathic Board should not look regulate this procedure. He stated that IPT is extremely dangerous, even at low doses, and should only be administered by an Oncologist.

Daniel Royal stated that, in his opinion, the use of Insulin Potentiation Therapy in low doses falls under NRS 630.040(2), and could be regulated by the homeopathic board.

Phillip Minton stated that the use of Insulin Potentiation Therapy requires a considerable training, and could be confusing to a patient seeking homeopathic treatment.

Fuller Royal suggested that David Edwards withdraw his request for a declaratory order and advisory opinion from the board at this time. The IPT discussion can be agendized for the next board meeting, which would give board members more time to study the subject matter and review the statutes and codes.

David Edwards withdrew his request for a declaratory order and advisory opinion in reference to the board's position on the use of Insulin Potentiation Therapy.

President Janie Greenspun-Gale directed the executive director to notify by mail all licensees of the July 19, 2003 board meeting, during which time a discussion on the use of Insulin Potentiation Therapy will occur.

9. Public Comment:
David Edwards reported that he and Fuller Royal testified before the Senate Commerce Committee on April 11, 2003, in regards to SB 389. Dr. Edwards stated to the Committee that singly licensed physicians under NRS 630A are fully qualified and trained as MD's or DO's, and need full prescription privileges. If an emergency were to arise during treatment, such privileges could prevent a delay in a patient receiving proper emergency treatment that requires the use of allopathic doses of medications. He believes the homeopathic board should seek to have full prescription privileges restored to licensees under NRS 630A during the 2005 legislative session.

10. Motion: Fuller Royal moved to change the August 23, 2003 meeting to July 19, 2003, to allow for the hearing for applicant Harvey Bigelsen at the earliest possible time.
