MINUTES
1. Call to order, roll call, and determination
of a quorum.
Meeting called to order at 10:10 a.m. with committee members
Fuller Royal, Phillip Minton, and Stuart Currie in attendance.
Also present in Reno were Robert Bryant and Ned Reed, Deputy
Attorneys from the Office of Attorney General
2. Election of Chairperson of the Educational
Committee.
Motion: Fuller Royal nominated Phil Minton as Chairperson
Second: Stuart Currie
Action: Passed unanimously
3. The Educational Committee discussed and took action in regards
to (in compliance with NAC630A.098):
a. A recommended board policy as to the approval
of courses, lectures, and workshops for continuing education
of HMD's, Advanced Practitioners of Homeopathy, and Homeopathic
Assistants.
Fuller Royal reviewed with the committee members
the Nevada Statutes and Regulations that pertain to any proposed
action in regards to this agenda item:
NAC 630A.098 Committee to examine and make recommendations regarding
education in homeopathy. (NRS 630A.200)
1.The president of the board shall appoint a committee composed
of the secretary-treasurer and two other members of the board.
The committee shall:
(a) Examine the educational activities, quality of training
seminars, meetings and materials used for educating homeopathic
physicians, homeopathic assistants or advanced practitioners
of homeopathy;
(b) Each January, provide a report to the board that explains
their findings; and
(c) Make recommendations to the board regarding the education
of homeopathic physicians, homeopathic assistants and advanced
practitioners of homeopathy. 2.The board may accept, reject
or alter any recommendation of the committee.
NRS 630A.325 Renewal: Requirements; suspension for nonpayment
of fee; notice to Federal Government. To renew a license other
than a temporary, special or limited license issued pursuant
to this chapter, each person (HMD, APH, HA) must, on or before
January 1 of each year:
(c) Submit evidence to the board of his completion of the requirements
for continuing education.
NAC 630A.096 Continuing education: General requirements; exemption;
failure to comply. (NRS 630A.200, 630A.295, 630A.299)
1. Except as otherwise provided in subsection 2, each homeopathic
physician, homeopathic assistant or advanced practitioner of
homeopathy applying for renewal of his license or certificate
must, at the time of annual registration, submit to the board
evidence in such form as the board requires, that he has completed
during the preceding year 20 credits of continuing education
in courses sponsored by the Nevada Homeopathic Integrative Medical
Association or the Arizona Homeopathic and Integrative medical
Association, or in courses approved by the board. Such credits
must include:
(a) Ten credits of continuing education in homeopathic medicine
as described in subsection 1 of NRS 630A.040; and
(b) Ten credits of continuing education in methods and therapies
described in subsection 2 of NRS 630A.040. (Italics added for
emphasis)
NRS 630A.040 "Homeopathic medicine" and "homeopathy"
defined. "Homeopathic medicine" or "homeopathy"
means a system of medicine employing substances of animal, vegetable,
chemical or mineral origin, including:
1. Nosodes and sarcodes, which are:
(a) Given in micro-dosage, except that sarcodes may be given
in macro-dosage;
(b) Prepared according to homeopathic pharmacology by which
the formulation of homeopathic preparations is accomplished
by the methods of Hahnemannian dilution and succussion or magnetically
energized geometric patterns applicable in potencies above 30X,
as defined in the official Homeopathic Pharmacopoeia of the
United States; and
(c) Prescribed by homeopathic physicians or advanced practitioners
of homeopathy according to the medicines and dosages in the
Homeopathic Pharmacopoeia of the United States, in accordance
with the principle that a substance which produces symptoms
in a healthy person can eliminate those symptoms in an ill person.
2. Noninvasive electrodiagnosis, cell therapy, neural therapy,
herbal therapy, neuromuscular integration, orthomolecular therapy
and nutrition. (italics added for emphasis)
Fuller Royal proposed that the committee consider the following
recommendations for approval by the full homeopathic medical
board in regards to continuing education credits:
1. Approval of in-office training pertaining to any of the therapies
listed in NRS 630A.040 by any licensed HMD in good standing
with the board; the licensee will certify by letter as to the
number of hours of training provided; training in any of the
therapies or modalities listed in NRS 630A.040(2) will be accepted
for satisfying NAC 630A.096(1)(b); and
2. Approval of any courses or workshops provided or approved
by the AMA, American Institute of Homeopathy, American Osteopathic
Association, American Association of Oriental Medicine, American
Naturopathic Medical Association, Othomolecular Medical Society,
and American College for Advancement in Medicine, and Courses
in Thought Field Therapy.
Motion: Phil Minton motioned that the committee forward Fuller
Royal's proposal to the board for approval, reminding the board
that a previous policy has been adopted whereby licensees and
certificate holders may submit a declaration to the board that
they have satisfactorily completed the required 20 credits of
continuing education, providing supporting documentation when
asked to do so, and that the board plans to "spot check"
randomly to assure that the statutes and regulations are being
followed. (See Minutes of 12-15-01 Board Meeting) Second: Fuller
Royal Action: Passed unanimously
b. Discussion and action were taken in regards to pre-licensing
workshops (i.e. test preparation) for applicants seeking licensure
under Chapter 630A of NRS, including fees for attending pre-licensing
workshops, selection of instructors, payment of instructors,
and workshop dates in relationship to examination times.
Fuller Royal proposed that the committee submit the following
for approval by the full homeopathic medical board:
The board select and approve licensees or certified APHs interested
in providing workshops and/or syllabuses, one from northern
and one from southern Nevada, to prepare and present workshops
and/or syllabuses for applicants preparing for examination in
cooperation with the Secretary-Treasurer, the fees for such
workshops to be approved by the board and not altered by the
instructor without full board approval.
Motion: Phil Minton motioned that Fuller Royal's proposal be
forwarded to the full board with a recommendation for board
approval. Second: Stuart Currie Action: Passed unanimously
4. PUBLIC COMMENT: Discussion Only.
No matter raised by the public that is not included in the agenda
will be acted upon.
Fuller Royal asked the committee members to consider supporting
a motion during the regular board meeting to modify the examinations.
Exam questions should be taken from specific texts, such as
Murphy's Homeopathic Repertory/Boericke's Materica Medica with
Repertory for the homeopathic section, one or two books for
each therapy, such as the nutrition, orthomolecular medicine,
etc.
Fuller Royal also asked the committee to consider supporting
a motion during the regular board meeting to have an APH certificate
holder selected to sit with the board during regular board meetings
to provide input and counsel when invited to do so.
