Minutes for the Public Hearing of LCB File No. R105-03

1. Meeting called to order at 11:05 a.m., visitors were welcomed, asked to sign in, and encouraged to participate in the public hearing. Roll call was taken to determine a quorum.

2. Board Members and Staff Present: Phillip Minton, Wendy Gallerani (Executive
Director), Ned Reed (Deputy Attorney General), Dave Edwards, Daniel Royal, Linda Read, Fuller Royal, and W. Brent Hardy

Board Members Absent: Diane Kennedy

Members of the Public Present: Robert Field, A.P.H., Frank Shallenberger, M.D., H.M.D.

3. Phillip Minton stated that the board had concluded a public workshop on LCB File No. R105-03, which is a regulation proposing amendments to chapter 630A of the Nevada Administrative Code. He asked for any comment. The Board's legal counsel, Ned Reed, expressed concern with the language in Section 28, which imposed a set fine for failure to timely file a change of address. The wording was changed in Section 28 to apply the fine only in instances in which the licensee waived a hearing. If the hearing is not waived, the licensee is subject to fines up to $10,000.00 that may be imposed by the Board and may be disciplined in accordance with chapter 630A of NRS or NAC. This Section will encourage licensees to notify the Board of change of address, and to pay the fine by waiving a hearing.

Dr. Shallenberger suggested additional language to define terms in Section 12 were added to the regulation.
