IMPORTANT ANNOUNCEMENT

On September 24, 2003, the
Legislative Commission unanimously approved changes in chapter
630A of the Nevada Administrative Code (NAC). These changes
are significant and will affect each homeopathic physician (HMD),
advanced practitioner of homeopathy (APH) and homeopathic assistant
(HA). Applicants, licensees, advanced practitioners of homeopathy,
and homeopathic assistants are encouraged to CAREFULLY REVIEW

LCB File No. R043-03 is a new regulation
that addresses possible problems arising from the intrastate
practice of homeopathic medicine using electronic means, such
as electronically, telephonically or by fiber optics, including
the Internet.
LCB File No. R105-03 makes changes
in the codes that regulate the practice of homeopathy and complementary
alternative medicine. A brief summary of the most important
changes are:
1. An application for licensure,
or for a certificate to practice homeopathy as an advanced practitioner
of homeopathy or for a certificate to practice as a homeopathic
assistant will not be returned to an applicant if his application
is rejected, and the application fee is nonrefundable. (NAC
630A.070, 630A.300, and NRS 630A.400)
2. Annual renewals of license and
certificate have increased 10% and are:
a. Licensee renewal--------------------$550.00
b. Certificate renewal (APH)---------$330.00
c. Certificate renewal (HA)---------- $165.00
3. Certificates will be suspended
if not paid by January 1 (APH and HA)
4. Licensees, APH, and HA must notify
the board within 30 days of any change in home or office address,
or face stiff fines and penalties. (NAC 630A.130)
5. Homeopathic physicians (HMD) will
face stiff fines for not completing and returning any official
practice surveys, questionnaires or other necessary information
required by the board within 30 days after the survey, questionnaire
or other necessary information is postmarked, and the physician's
response must be legible. (subsection 4 of NAC 630A.132)
6. Any judgment entered against an
HMD or APH must be reported to the board within 60 days after
the judgment is entered or the settlement is reached. Failure
to do so could result in a fine up to $10,000.00 and penalties.

This brief overview covering some
of the important changes in the Nevada Administrative Code should
not substitute for reading the entire document. For example,
the board has approved AMA category I and AOA category A credits
as satisfying the required 20 credits of continuing medical
education (CME) . . . as long as they include instruction in
the therapies listed in subsection 2 of NRS 630A.040: Noninvasive
electrodiagnosis, cell therapy, neural therapy, herbal therapy,
neuromuscular integration, orthomolecular therapy and nutrition.
In conclusion, NAC 630A has been
edited by the board office and will be posted on the board's
webpage (http://www.nvbhme.com/statutes.html) with the new language
and changes included. This is not the official chapter 630A
of NAC. The Legislative Counsel Bureau will make the official
